How to File a Trademark Application in Iraq

After acceptance at preliminary examination, the application is filed electronically and the official filing fees are paid by bank card.

Filing the application

  • A single trademark application may cover multiple classes; it is permissible to file one application including more than one class.
  • The Trademark Office reviews the examination status of all classes concerned and informs us of any refused class or any class whose result has not yet been issued. Once all examination results have been issued and cleared, the payment assessment is activated so that the official fees can be paid.
  • The Registrar allows the list of goods in the trademark application to be reduced compared with the preliminary examination application, but no additions are allowed.
  • A filed trademark application cannot be amended, even by the Trademarks Office’s own employees, to prevent any manipulation of applications. New goods require a new filing application.

Before you file

  • The examination result remains valid for three months from its date of issuance, and the trademark application must be filed within that period. If the three months expire before filing, a new examination request, with its fees, is required.
  • A copy legalised up to the Embassy goes in with the examination request; the original, with all the local legalisations, is due within six months of the filing date.
  • The requirements for filing an electronic trademark search application in Iraq include a power of attorney legalised up to the Iraqi Embassy, which must be uploaded with the application. In October 2026 we noted that uploading the legalised power of attorney is mandatory for each examination request.

Using the system

  • Access to the Trademark Office’s online system is linked to the mobile phone number through which the application was originally submitted. Under the current electronic system, payment must be made through the same mobile phone number/account that was used for payment of the original filing fees.
  • Under Iraqi law, a deadline falling on an official holiday is extended to the next working day. The Trademark Office accepts no official fee payments on Iraqi public holidays or on the last working day of each month.
