A power of attorney is required to file a trademark application in Iraq. It must be notarised and legalised up to the Iraqi Embassy or Consulate in the applicant’s country.
What the Trademark Office requires
- The requirements for filing an electronic trademark search application in Iraq include a power of attorney legalised up to the Iraqi Embassy, which must be uploaded with the application. In October 2026 we noted that uploading the legalised power of attorney is mandatory for each examination request.
- For trademark registration the power of attorney is to be legalised by the Iraqi Embassy, the Income Tax Authority, the Ministry of Trade and the Iraqi Ministry of Foreign Affairs.
- A copy legalised up to the Embassy goes in with the examination request; the original, with all the local legalisations, is due within six months of the filing date.
- The same power of attorney may be used to register any number of trademarks for an unlimited period of time.
Individual applicants
- In December 2025 we confirmed that individuals are permitted to register trademarks in Iraq. The requirements do not substantially differ from those for a company; the main one is a duly legalised power of attorney, authenticated up to the Iraqi Embassy.
The Kurdistan Region
- The same duly legalised power of attorney used for trademark registration in Baghdad may also be used for filing the corresponding trademark application in Kurdistan. There is no need to arrange a separate power of attorney or repeat the embassy legalisation process, provided that the existing power of attorney meets the applicable requirements.
- The Kurdistan Registrar no longer accepts a power of attorney that was legalised by the Iraqi Embassy more than three years earlier.
Renewals
- A renewal needs a power of attorney legalised up to the Iraqi Embassy.
Oppositions
- The power of attorney must be legalised by the Iraqi Embassy upon filing the opposition, and the locally legalised power of attorney must be filed within 30 days from the date of filing the opposition (August 2026).
- The duly legalised power of attorney must be submitted with the opposition application. If it is not fully legalised, a copy legalised by the Iraqi Embassy may be submitted, and a period of 30 days is granted to provide the fully legalised power of attorney (April 2026).
