To proceed we generally require: a clear representation of the trademark; the applicant’s full name, address, nationality and legal status; a detailed list of the goods and services; the relevant classes; and a duly legalised power of attorney.
The mark and the goods
- The requirements for filing an electronic trademark search application in Iraq include a clear image of the trademark in the foreign language, together with its transliteration into Arabic.
- The preliminary search can be conducted on the names alone, without the final logos; the final logos are not required for the search.
- A list of the goods in accordance with the Nice Classification (11th edition) is required. Please highlight the required goods in yellow and send the marked list each time you instruct us to file a search application.
Foreign applicants and individuals
- A foreign applicant should act through a local representative in Iraq.
- A power of attorney is required to file a trademark application in Iraq. It must be notarised and legalised up to the Iraqi Embassy or Consulate in the applicant’s country.
- In December 2025 we confirmed that individuals are permitted to register trademarks in Iraq. The requirements do not substantially differ from those for a company; the main one is a duly legalised power of attorney, authenticated up to the Iraqi Embassy.
- In some cases the Trademarks Registrar may request an official letter from the manufacturing entity confirming its no-objection to registration in the individual’s name. A document known as the ‘Manufacturing Certificate’ may also be requested by the Registrar and must be duly legalised up to the Iraqi Embassy (December 2025).
Priority
- If priority is claimed, a certified copy of the priority application must be submitted within the prescribed legal time limit. We submit a copy of the priority document, not the original.
Pharmaceutical marks (Class 5)
- Since a 2017 decision of the Iraqi Council of Ministers, foreign companies seeking to register trademarks in Class 5 for pharmaceutical preparations must submit a registration certificate from the country of origin. If the owner does not possess one, it may submit a registration certificate issued in any other country, provided that it clearly identifies the trademark owner and the owner’s country of origin. If this is not possible, the same statutory period applicable to the submission of the power of attorney applies, namely six months from the filing date of the trademark application. Until the certificate is submitted the application remains suspended and does not proceed to publication.
The Kurdistan Region
- For trademark registration in the Kurdistan Region, in addition to the power of attorney (which must also be legalised by the Kurdistan authorities after the Baghdad legalisation procedures are completed), we require a certified true copy of the Certificate of Registration, legalised up to the Iraqi Embassy. It does not need to originate from the country of origin; it may be issued by any country other than Iraq.
- In the Kurdistan Region the original power of attorney and the certificate of origin of the trademark must be legalised by the Iraqi Embassy, the competent authorities in Baghdad and then the relevant authorities in the Kurdistan Region. Otherwise it is not possible to file a trademark application.
