In July 2025 we explained to an agent:
- An unpublished trademark cannot be renewed.
- A published trademark whose final registration fees have not yet been paid can be renewed, provided the final fees and the renewal fees are paid together.
Asked how long a renewal certificate takes, we said there was no specific timeframe: the Trademarks Registrar was facing a huge backlog of marks without registration or renewal certificates, with no immediate solution.
Asked which law fixes the date from which protection runs, we said nothing in Iraqi law supports the start of the protection period except the Trademark Registration Certificate itself, whose template was annexed to the law and is considered an integral part of it.
If an Iraqi mark is close to its anniversary:
- Check its publication status at the Office first
- If published, pay the final and renewal fees together instead of waiting for the certificate
- If unpublished, review the file with us; an unpublished mark cannot be renewed
