In one file, the foreign agent asked for the other side's appeal memorandum, the impact if it succeeds, and a forecast of the outcome.
The Court of Cassation is a court of papers rather than pleadings. The cassation memorandum is filed directly with the court, so we could not obtain a copy of it, and we were not required to submit a response. Only the party adversely affected by a decision is entitled to appeal; the winning side's job is to wait for the decision.
In that cancellation file, the defendant's cassation appeal was reported in October 2025. The decision reached the foreign agent in January 2026: Cassation upheld the first-instance decision and confirmed the cancellation of a defendant's trademark.
What to tell your client early:
- There is no response to file and no memorandum to obtain
- The next document you will see is the cassation decision itself
- In this file it took roughly three months
- Do not expect a forecast: it depends on the judges' convictions, and we had not seen the appeal arguments
