In one of our files, an application filed in 2017, the owner wanted to amend a registered trademark in Iraq. The Registrar first approved the filing of the amendment application, then withdrew that approval because the registration certificate had already been issued.
A later attempt with the current Registrar also failed, and no written decision was available. The only route left was a new application under the new name of the mark.
The consequence: a second application, a second set of costs, and a period when the amended version has no protection of its own.
Before you change a mark in Iraq:
- If a change is planned, try to file it before the original certificate is issued.
- If the certificate is already out, ask your Iraqi agent early whether a new filing is the only route.
- Budget for a second application from the start.
- Do not count on a written refusal you can show the business.
