In one recordal file, a foreign agent asked us to check whether documents for an assignment and a change of name were acceptable. The affidavit of change of name was very clear and sufficient for use here. The deed of assignment, however, did not state the addresses of the assignor or the assignee, and we feared it might not be accepted.
The point is timing. Catching a gap like that on a draft costs an email. Catching it after notarisation and legalisation may mean signing the deed again and repeating the chain, with weeks lost.
Before legalising recordal documents for Iraq:
- Send the draft deed and any name-change evidence to your Iraqi agent first.
- Make sure the full addresses of both assignor and assignee appear in the deed.
- Ask directly: will the office accept this as drafted?
- Only then sign, notarise and legalise.
