Your search cites an older application in someone else's name. Before planning a court cancellation, check whether that file is even complete.

Filing

In 2025 we explained to agents how this often plays out. When the examiner finds an older application filed by another applicant, the Office's usual step, as we described it, is a warning letter asking that applicant to re-file or complete the file within seven days (one week in another file). If nothing happens, the older application is treated as cancelled and the new one is accepted.

In one 2025 file we expected the Registrar to hold off on a citation and send that letter instead. The cited application was suspended from publication for lack of a certificate of manufacture from a local or foreign factory, confirming the product is made for the trader and that the factory has no objection to registration in the trader's name.

When an unpublished earlier application blocks you:

  • Ask us what is missing from the cited file
  • Ask whether a warning letter is likely
  • Only then decide whether court action is needed
  • For a re-filing by a related company, ask the same question
