A wrong class in a trademark filing cannot always be patched after filing, and in our files Baghdad and Kurdistan dealt with it differently.

Filing

In one 2025 file, a wrong class came to light after the Baghdad application had been filed. As we advised the agent, sub-classes can currently no longer be added to a filed application. The correct class had to go in as a new, separate application, with a new number and a new filing date, and the old application could simply be left pending.

In the Kurdistan file, to avoid waiting one or two months for a new search result, the earlier search result was reused and the application was filed under the same classes. The class was to be corrected after filing, which was expected to be easier to process.

The cost of the Baghdad route: a later filing date and a second application to pay for.

Practical checks:

  • Compare the class and goods in the instruction letter with the Iraqi list before it goes out.
  • If an error surfaces after filing, ask at once which route applies at that office.
  • Leave the unwanted class out of the new application.
