A power of attorney is required to file a trademark application in Iraq. It must be notarised and legalised up to the Iraqi Embassy or Consulate in the applicant’s country.
Do you have to be in Iraq?
- A foreign applicant should act through a local representative in Iraq.
- In December 2025 we confirmed that individuals are permitted to register trademarks in Iraq. The requirements do not substantially differ from those for a company; the main one is a duly legalised power of attorney, authenticated up to the Iraqi Embassy.
What you send us
- To proceed we generally require: a clear representation of the trademark; the applicant’s full name, address, nationality and legal status; a detailed list of the goods and services; the relevant classes; and a duly legalised power of attorney.
- The requirements for filing an electronic trademark search application in Iraq include a clear image of the trademark in the foreign language, together with its transliteration into Arabic.
- A list of the goods in accordance with the Nice Classification (11th edition) is required. Please highlight the required goods in yellow and send the marked list each time you instruct us to file a search application.
The power of attorney, signed where you live
- For trademark registration the power of attorney is to be legalised by the Iraqi Embassy, the Income Tax Authority, the Ministry of Trade and the Iraqi Ministry of Foreign Affairs.
- A copy legalised up to the Embassy goes in with the examination request; the original, with all the local legalisations, is due within six months of the filing date.
- The same power of attorney may be used to register any number of trademarks for an unlimited period of time.
What we do in Iraq for you
- Protection in Federal Iraq (Baghdad) and in the Kurdistan Region requires separate procedures. A Baghdad registration protects all of Iraq except the Kurdistan Region, and a Kurdistan registration protects only the Kurdistan Region.
- The Iraqi Trademark Office has discontinued the separate trademark availability search service. Currently, the only available procedure is filing a preliminary examination application.
- After acceptance at preliminary examination, the application is filed electronically and the official filing fees are paid by bank card.
- A publication report is then prepared and we are notified by SMS to pay the publication fees. The trademark is subsequently published in the Official Gazette on the website of the Iraqi Ministry of Industry and Minerals.
- A published mark is open to opposition for 90 days from the date of publication.
- A trademark is considered duly registered and legally protected once the final registration fee has been paid, regardless of the subsequent administrative issuance of the registration certificate.
