In our files, a change of address in Baghdad was published only once. Getting it to the gazette was the hard part.

Recordals

From one portfolio of change-of-address recordals at the Iraqi Trademark Office, filed in late 2024: the recordal was published one time in the Official Gazette, and the recordal certificate could be paid after a one-month opposition period. For one mark in the batch, publication came about two and a half months after filing.

Two things had to be cleared. Some marks had no registration certificate issued and no registration fees paid, so those fees, and unpaid renewal publication fees, had to be paid when the applications were filed. And some applications went in before the POA was legalised, so the publication fee could not be paid then. Once the POA was legalised, the Registrar refused to accept the publication fee unless reclassification applications were submitted for those marks.

Before filing a recordal in Iraq:

  • Ask your agent to check unpaid registration fees and renewal publication fees on every mark in the batch
  • Have the legalised POA ready at filing
  • Prepare the goods lists for reclassification in parallel, in case the Registrar asks for them
