A foreign agent asked us in October whether anything had changed in Iraq, since they had understood that patent applications were only examined as to form.

Patents

Our answer: patent applications in Iraq undergo a thorough substantive examination, not merely a formal one, carried out by a panel of specialised university professors selected by field of expertise.

If an application is refused, the examiner's findings and grounds are attached to the official refusal letter, for example lack of novelty and inventive step.

If the applicant appeals the Patent Registrar's refusal, the appeal is first submitted to the Minister's Office and then referred back to the Registrar, who appoints a new technical examiner to review the previous findings together with the applicant's arguments and evidence. That second opinion is treated as final at the administrative examination stage. If the refusal is upheld, the remaining route is a challenge before the competent Administrative Court.

When an Iraqi patent refusal arrives:

  • Read the examiner's grounds closely
  • Answer each ground point by point, with technical and factual arguments
  • Support the response with relevant evidence
  • Treat the appeal as a later step, not the main plan
